Termos de Serviço
Version 1.0
§1. General provisions
- SplitTeach is an educational platform providing the technological infrastructure for publishing, searching and using educational content, and for communication and live classes.
- SplitTeach is not a school or an educational institution and, as a rule, does not itself provide the educational services offered by Educators.
- These Terms apply globally, subject to the mandatory provisions of law applicable to the User.
- The availability of features may depend on the country, account type, legal requirements and technical capabilities.
§2. Definitions
- User – a person using the Platform.
- Participant/Student – a User who uses an Educator's content or services.
- Educator – a User who publishes educational content or offers Courses or Live classes.
- Guardian – a parent or legal guardian of a minor Student, giving consent for the minor to use the Platform in accordance with §5.
- Course – previously prepared educational content made available under the terms of an offer.
- Individual Live – a live class between an Educator and a single Student.
- Group Live – a live class conducted by an Educator for more than one Student.
- Content – materials, recordings, texts, graphics, files, comments, publications and other materials created by Users.
§3. Nature of SplitTeach
- SplitTeach performs a technological and organisational function, enabling Educators to offer services and Students to use them.
- For a paid Course or Live class, the contract relating to a specific service is, as a rule, concluded between the Educator and the Student.
- SplitTeach may technically handle the order, payment, access, communication, commission settlement and security.
- The Educator is responsible for the offer, the content and the performance of the service, subject to SplitTeach's obligations arising from law.
§4. Account
- The User provides true and current data required to use a given feature.
- SplitTeach may require additional verification for security, payment or legal-compliance reasons.
- SplitTeach may restrict account features in the event of a breach of law, these Terms or security rules.
- The rules for creating and using an Account by minor Users are set out in §5.
§5. Minor Users
- Under the current model, the Platform is available to persons who have turned 13. SplitTeach does not currently offer a separate mode for younger persons.
- Users aged 13 to 18 may use the Platform and enter into transactions only with the Guardian's consent, expressed during Account registration or in another form indicated by SplitTeach, in accordance with the rules on limited legal capacity applicable to the User.
- Regardless of the above, where the GDPR applies, the processing of personal data based on the User's consent (in particular e-mail marketing and cookies requiring consent) requires, for a User under 16, consent or confirmation by the Guardian, pursuant to Article 8 GDPR – irrespective of the age threshold relevant to the validity of the contract itself.
- SplitTeach reserves the right to verify the Guardian's consent, including by contacting the Guardian, and to suspend the Account until that consent is confirmed.
- Only an adult with full legal capacity may become an Educator on the Platform.
§6. Educator
- An Educator may activate selling features after completing the data required for their business and market.
- The data may include identification and contact details, status as a natural person or entrepreneur, registration and tax data, and data required for payments.
- Missing required data may prevent the publication of offers, the acceptance of payments, or payouts.
- The detailed obligations of the Educator are set out in the Educator Terms.
§7. Comments
- The Platform may allow Users to add comments under Courses and other publications by Educators.
- At the MVP stage, comments do not constitute a separate rating or ranking system – they are a form of public statement, not a structured review with stars or scores.
- A comment must comply with the law, these Terms and SplitTeach's Community Guidelines. In particular, it is prohibited to post unlawful, harassing, misleading content, or content that infringes the rights of third parties.
- The author of a Course (the Educator) may reply to comments relating to their content.
- Comments are subject to the same reporting and moderation procedure as other Content on the Platform – in accordance with §12.
- SplitTeach may remove or hide a comment that breaches these Terms, the law or the Community Guidelines, in accordance with §12.
§8. Offers
- The Educator is responsible for the truthfulness, completeness and currency of the offer.
- Unlawful, misleading content, or content that infringes the rights of other persons, is prohibited.
§9. Search
- SplitTeach may provide a search engine, categories and filters.
- The position of content may depend on relevance to the query, category, completeness of the offer, recency and availability. The main parameters and their relative weight may be described in a separate notice on the Platform, without disclosing algorithmic details.
- At the MVP stage, an Educator's activity is not, on its own, a ranking criterion.
§10. Courses and Live classes
- The Educator determines the scope, price and terms of a Course or Live class.
- A Live class may use a camera, microphone, video and audio transmission, and screen sharing, where the feature is available.
- Under the current MVP model, Live classes are not recorded either by SplitTeach or by the Educator. Video and audio are transmitted only in real time between the participants of the class and are not stored.
- Introducing a recording feature in the future will require a separate update to these Terms and to the Privacy Policy before it is made available, including determining the purpose, legal basis and retention period of any recordings.
§11. Payments
- SplitTeach may use Stripe Connect and other payment operators.
- SplitTeach's commission is 7% of Course sales and 5% of Live sales, unless separate terms provide otherwise.
- Payment operator fees may be charged to the Educator.
- Refunds and chargebacks may affect the Educator's balance.
§12. Reporting content and the DSA
- SplitTeach provides a "Report content" feature, including reports of spam, harassment or hate speech, unlawful content, adult/nudity content, violence, disinformation, copyright infringement and other issues. The feature also covers comments referred to in §7.
- The User may add further information.
- SplitTeach records and reviews reports and takes the action required by law.
- SplitTeach makes the detailed content-reporting and moderation procedure available in a separate document.
§13. Intellectual property
- The Educator retains the rights to their own Content.
- By publishing Content, including a comment, the User grants SplitTeach a non-exclusive licence necessary to host, store, display, play back and technically make the Content available on the Platform.
- The User represents that they hold the rights or permissions necessary for publication.
§14. Privacy and cookies
- The rules for processing data are set out in the Privacy Policy.
- SplitTeach uses necessary technologies and Google Analytics in accordance with the Cookie Policy and the consent mechanism, where consent is required.
- Where SplitTeach acts as a processor for an Educator, the relevant Data Processing Agreement (DPA) applies.
§15. Governing law and consumers
- These Terms are governed by Polish law, subject to the mandatory provisions of law applicable to the User, in particular consumer-protection rules.
- These Terms do not exclude a consumer's statutory rights.
- SplitTeach may apply regional addenda where required by law.
